Updated – Guidelines for a Claims Agent

Important changes to the Guidelines for a Claims Agent:

  • Appointment of a Claims, Noticing and Balloting Agent (the “Claims Agent”) is required if there are 1,000 or more creditors in a case and may be required by the court in other circumstances.
  • Claims agents must maintain an up-to-date copy of debtor's schedules that list the creditors and the amounts owed, and maintain an accurate and up-to-date mailing list.

The PDF download for "Guidelines for a Claims Agent" has been updated to reflect the above information. See the list of revised bullets below for the changes.

  • C.3.e. (Updated) - notice of judgments or orders pursuant to Administrative Order 2011-02
  • C.5. (Updated) - Maintain an up-to-date copy of debtor's schedules that list the creditors and the amounts owed, and maintain an accurate and up-to-date mailing list.
  • C.19.a. (New) - The claims agent will file a Notice of Termination, using the approved local form available on the court's website.
