Adversary Proceeding Filing Requirements
(Original plus 2 copy)

A lawsuit arising in or related to a bankruptcy case that is comenced by filing a complaint with the court.

Documents Required WITH the Petition (Minimum Filing Requirements)
  1. Complaint and Adversary Cover Sheet
  2. Summons (Filing party to attach a copy of adversary complaint packet to their copy)
  1. $250.00 Filing Fee unless plaintiff is:
    • Trustee (in all chapters)
    • Chapter 7, 12, or 13 debtor
    • Chapter 11 debtor who does not have confirmed plan
      • E-Filers: Payment must be made electronically with a credit or debit card
      • Pro Se: Payment must be made by Money Order, Cashier’s Check or Cash
        - Exact change is required
        - No Personal checks from debtors are accepted

Note: Pursuant to Rule 7004(e), the Summons, Complaint, and Preliminary Pretrial Order must be served within 10 days from the date the Summons is issued.  Proof of Service is required to be filed with the Court.
