How do I file?
 


1. Petition forms, where can I obtain?

Petition forms may be downloaded at no charge from the “Forms” section of this web site. A package of the forms required for filing may also purchased from any legal stationery store.

 

2. Attorney, Do I need one to file bankruptcy? 

While it is possible to file a bankruptcy case pro se, that is, without the assistance of an attorney, it is extremely difficult to do so successfully. Hiring a competent attorney is highly recommended. If you are unable to afford an attorney, you may be able to qualify for free legal representation? For information about other referral programs, contact your local bar association.

Pursuant to Local Bankruptcy Rule 9010, a corporation, partnership or unincorporated association may not file for bankruptcy without counsel.

 

3. Bankruptcy Court fees, How can I pay?

The Bankruptcy Court will accept cash, U. S. Postal Service money orders, cashier's checks issued by an acceptable financial institution, attorney or law firm checks (payable to the U. S. Bankruptcy Court) and American Express, Diner's Club, Discover, MasterCard, and VISA for payment of fees. Credit card transactions must be made in person by the cardholder; however, this does not apply to electronically filed documents. The Court does not accept personal checks or credit cards from debtors to pay fees. All attorney/law firm checks must include a current pre-printed name, street address, telephone number, and California attorney bar number. Please do not send cash through the mail.

 

4. What are the Filing Requirements?

5. Emergency filing after-hours, what if I have one?

The Court's normal operating hours are from 9:00 a.m. to 4:00 p.m., Monday through Friday, except federal holidays.

In emergency situations filings may be accepted at other times; however, a pre-approved appointment must be arranged. Contact the appropriate Intake office to arrange for an emergency filing:

Can you Recommend an Attorney?
  We are prohibited from directing you to a particular attorney. You may, however, call the legal aid society or look through the telephone directory for bankruptcy assistance.

Where Can I Find Legal Help?
  Clark County Legal Services

 

  Clark County Legal Services in conjunction with the William S. Boyd School of Law and Nevada Legal services provide a weekly bankruptcy Legal Education Class as a community service that is open to all members of the public. The class process legal information to the public about Bankruptcy Court procedures, rules, and Nevada law. They also provide a wide variety of the necessary forms to assist you with representing yourself in court. This class is not intended to take the place of an attorney and we highly recommend that you consult with a private attorney before filing any court documents.
