Alert for Chapter 13 Debtors and Practitioners

11 U.S.C. ยง 1329(d), enacted under the CARES Act, permitting extension of the term of certain chapter 13 plans to 7 years, will expire on March 27, 2021, unless extended by Congress. Any debtors who qualify for a modification under the terms of that provision must act promptly to secure the requested relief prior to the expiration of the provision. Such requests for modification do not appear to be eligible for hearing on shortened notice. See Fed. R. Bankr. P. 9006(c)(2), referencing Fed. R. Bankr. P. 3015.
